डायरेक्ट सेलिंग पर सरकार की गाइडलाइन जारी

उपभोक्ता मामलात मंत्रालय, भारत सरकार की ओर से आज डायरेक्ट सेलिंग व मल्टीलेवल मार्केटिंग को लेकर देशभर में दिशा निर्देश जारी कर दिए गए हैं। लम्बे समय से लम्बित चले आ रहे इस मामले को गाइडलाइन जारी होने के साथ ही अब नई दिशा मिलेगी। इस संबंध में आज शाम सभी राज्य सरकारों व केन्द्रशासित प्रदेशों को अधिसूचना भी जारी कर दी गई है। साथ ही केन्द्र की ओर से इस गाइडलाइन को यथास्थिति लागू करने को कहा गया है।

उपभोक्ता मामलात मंत्रालय के अनुसार इस गाइडलाइन को डायरेक्ट सेलिंग गाइडलाइन- 2016 के नाम से जाना जाएगा। इस गाइडलाइन में सरकार ने कुल नौ धाराएं शामिल की हैं, जिनकी 52 उपधाराओं को जोड़ा गया है। इस गाइडलाइन के साथ ही देशभर में चल रही पोंजी और पिरामिड स्कीमों पर रोक लगेगी और उत्पादों पर आधारित कंपनियों को नई ऊंचाईयां छूने का अवसर मिलेगा। गौरतलब है कि पोंजी और पिरामिड स्कीमों के नाम पर मनी रोटेशन कर रही कंपनियां बिना उत्पादों के नेटवर्क बना रही थी, जिनपर इस गाइडलाइन के साथ ही लगाम लग जाएगी। इस गाइडलाइन में मुख्य रूप से सरकार ने डायरेक्ट सेलिंग और पोंजी स्कीमों में अंतर बतलाया है। सरकार के अनुसार अब केवल जुडने अथवा जोइनिंग पर कमीशन बांटने पर पाबंदी होगी। लेकिन डायरेक्ट सेलिंग में उत्पादों की बिक्री के आधार पर डायरेक्ट सेलर को कमीशन दिया जाना संभव होगा। गाइडलाइन में ग्राहक हितों को ध्यान में रखते हुए कंपनियों को अपने बिक्री के उत्पाद अथवा सेवाओं पर 30 दिन की मनीबैक गारंटी लागू करने के निर्देश भी दिए गए हैं। अब डायरेक्ट सेलर्स को कंपनियों की ओर से नियमानुसार पहचान भी जारी किए जाएंगे। डायरेक्ट सेलिंग कंपनियों को अपने सभी डायरेक्ट सेलर्स के डाटा रखने होंगे और पैन कार्ड व प्रमाणिक आईडी रखना जरूरी होगा। साथ ही साथ कंपनियों को अपनी अपडेटेड वेबसाइट पर प्लान, उत्पादों की पूरी जानकारी, कंपनी का पता, संपर्क तथा शिकायतों के लिए प्रकोष्ठा रखना आवश्यक होगा, जिनका निवारण शिकायत मिलने के 45 दिनों में कंपनियों को करना होगा।

गाइडलाइन में सरकार की ओर से सीधे तौर पर निर्देशित किया गया है कि डायरेक्ट सेलिंग के जरिए बेचे जाने वाले उत्पाद व सेवाओं पर लगने वाले कर जिनमें वैट शामिल है का हिसाब-किताब कंपनियां रखेंगी, व तय समय पर टैक्स जमा करवाएंगी। सरकार ने दिशा-निर्देशों में किसी भी प्रकार के रिनिवल पर रोक लगाई है। गाइडलाइन में यह भी निर्देशित किया गया है कि डायरेक्ट सेलिंग कंपनी और डायरेक्ट सेलर के बीच इंडियन कॉन्टे्रक्ट एक्ट 1872 के तहत करार होगा, जिसके आधार पर दोनों मिलकर काम कर पाएंगे। इसमें ग्राहकों को कूलिंग-ऑफ पीरियड की सुविधा भी निर्देशित की गई है। यह एक तय समय होगा, जिसमें ग्राहक संतुष्ट नहीं होने की स्थिति में कंपनी से अपना करार रद्द करने का हकदार होगा। निर्देशों के अनुसार कंपनियों को किसी भी ऐसे डायरेक्ट सेलर का करार रद्द करने अथवा आईडी टर्मिनेट करने का हक होगा, जो बीते दो वर्ष या इससे अधिक समय से सक्रिय नहीं है। यहां सक्रियता उसकी दो वर्षों में एक भी खरीदारी नहीं करने को माना गया है। टर्मिनेशन की स्थिति में कंपनी को उचित कारण भी बताना जरूरी होगा।

डायरेक्ट सेलर्स को मिलेगी पहचान

दिशा-निर्देशों के अनुसार अब डायरेक्ट सेलर को किसी भी संभावित ग्राहक से मिलते समय अपना आईडी कार्ड साथ रखना जरूरी होगा। साथ ही साथ अपने उत्पाद, सेवा इत्यादि की कीमत, क्रेडिट टर्म्स, टर्म्स ऑफ पेमेंट, रिटर्न पॉलिसी, टर्म्स ऑफ गारंटी व आफ्टर सेल्स सर्विस की जानकारी ग्राहक को देनी होगी। इन दिशा-निर्देशों मेंं सरकार ने डायरेक्ट सेलर्स को भी अधिकार सौंपे हैं। इनमें डायरेक्ट सेलर को कंज्यूमर प्रोटेक्शन एक्ट 1986 के अंतर्गत मानते हुए अधिकार दिए हैं। अब हर कंपनी में ग्राहकों अथवा डायरेक्ट सेलर्स की समस्याओं को सुलझाने के लिए तीन सदस्यीय ग्रिवेंस रेडरेसल कमेटी होना आवश्यक होगा, जो सभी शिकायतों के निवारण का कामकाज सुचारू रूप से देखेगी।

अच्छी कंपनियों को मिलेगी ऊर्जा

फेडरेशन ऑफ डायरेक्ट सेलिंग एसोसिएशन (एफडीएसए) सहित फेडरेशन ऑफ इंडियन चैम्बर्स ऑफ कॉमर्स एण्ड इंडस्ट्री (फिक्की) की ओर से इस संबंध में सालों से प्रयास जारी थे। इस गाइडलाइन को जारी करते हुए उपभोक्ता मामलात मंत्री रामविलास पासवान ने कहा है कि यह गाइडलाइन डायरेक्ट सेलर्स के हितों को ध्यान में रखते हुए जारी की गई है। जिसके जरिए इस उद्योग में बेहतर काम करने वाली कंपनियों को नई ऊर्जा मिलेगी।

केरल और राजस्थान आगे

डायरेक्ट सेलिंग को लेकर केरल सरकार की ओर से आज से ठीक पांच साल पहले यानी 12 सितम्बर, 2011 को देश में पहली बार दिशा-निर्देश जारी किए गए थे। इसके बाद राजस्थान सरकार ने भी 5 अक्टूबर 2012 को आठ नियम व शर्तों के साथ दिशा निर्देश जारी कर दिए थे। भारत सरकार की ओर से केरल और राजस्थान में पहले से लागू आदेशों को इस गाइडलाइन में तवज्जो दी गई है।

बेहतरीन कंपनियों को है बड़ा बाजार

इस गाइडलाइन के जारी होने के साथ ही उत्पादों पर आधारित कंपनियों को बड़ा लाभ मिलेगा। देश में एम्वे इंडिया, टपरवेयर, ओरिफ्लेम, एमआई लाइफस्टाइल, डीएक्सएन, हर्बललाइफ, एवॉन, वेस्टीज, एल्टॉस, थियांसी सरीखी बड़ी कंपनियों का डायरेक्ट सेलिंग कारोबार के बड़े हिस्से पर कब्जा है। इस गाइडलाइन के साथ ही इन स्थापित कंपनियों सहित उत्पादों पर आधारित साफ-सुथरी कंपनियों के कारोबार में बड़ा उछाल आएगा। साथ ही कंपनियों में उत्पादों की नई रेंज भी देखने को मिलेगी। दिलचस्प बात यह भी है कि गाइडलाइन जारी होने के पहले ही इन कंपनियों समेत कई कंपनियों ने अपने कारोबार में सरकार को समर्थन देते हुए ग्राहकों के लिहाज से बेहतर बदलाव कर लिए थे।
